GENERAL Welcome to Eon Dental NV Privacy Policy (“Policy”). For the purposes of this Policy, the terms (“Eon”, "we", "us", "ours") refer to Eon Dental NV which is engaged in the business of designing, manufacturing, selling, distributing and servicing custom made clear aligners for orthodontic treatment (the “Product”). This Policy allows you to understand how Eon collects and processes information that identifies, relates to, describes, is capable of being associated with or reasonably linked to a natural person that maybe considered personal ("Personal Data").
By using our online Eon website and/or its case management portal for treatment setup and customer communication ("Platforms") to provide Eon with information, you agree to the terms of this Policy and that you are adequately informed of the functions and objectives of our services and Product. You must refrain from interacting with our Platforms if you do not agree to this Policy.
If you are using the Platforms to provide Personal Data on behalf of other people you represent and warrant that you secured their prior approval through signing The Patient Information Consent Form and you acknowledge your full responsibility for the provision of their Personal Data without their approval.

Eon (i) collects, (ii) uses, (iii) retains and (iv) shares with Eon affiliates, associates, authorized representatives or other related entities, Personal Data provided by you or collected by us for all purposes necessary to ensure the proper course of treatment with the Product.
These purposes include (collectively the “Purpose”):
- Processing orders, developing treatment setups, manufacturing and shipping the Product and scheduling medical check-ups;
- Analyzing the function of, evaluating and improving our Product including the development of additional products and/or services;
- Carrying out quality control activities and modifying our Product to meet compliance standards;
- Performing internal business functions including invoicing, accounting and auditing;
- Providing customer support, responding to inquiries and fulfilling requests;
- Providing information about our Products, Services, general marketing and promotional purposes, courses and events;
- Educating our customer care employees during training;
- Processing any applications for employment, training or internship;
- Complying with and enforcing any applicable legal obligations and this Policy
3. DATA RETENTION AND DELETION
We may retain Personal Data for as long as reasonably needed to provide you with the Product for the Purposes described in this Policy. The criteria used to determine our retention periods include:

- whether there is a legal obligation which we are subject to;

We will not share Personal Data with third party suppliers or service providers other than Eon affiliates, associates, authorized representatives without obtaining your prior consent unless this is necessary for the Purposes set out in this Policy.
We may, however, share Personal Data with third parties who help us to provide, understand, improve and commercialize our Product or how we may otherwise engage with you. We may also share Personal Data with third parties, to permit them to send you marketing materials, consistent with your choices.
Furthermore, we may share Personal Data with third parties if Eon is involved in an acquisition or disposal of stock, equity, or asset and as well as insolvency, bankruptcy, liquidation, winding-up or receivership.
We seek to provide any such third parties only with the Personal Data they need to perform their specific function and we do not authorize them to use or share Personal Data except as strictly necessary to perform any services under our supervision or to comply with applicable legislation. In any event, such third parties shall be obliged to treat your Personal Data in a manner consistent with this Policy. Upon written request, Eon can provide you with a list of people that have or may have had access to your Personal Data.
6. CHILDREN'S POLICY
Collection of Personal Data is intended for adults only and is not intended towards children, minors, or anyone under the age of 18. If you are under the age of 13, you are not authorized to provide us with any Personal Data. If the parent or guardian of a child under 13 believes that the child has provided us with any Personal Data, the parent or guardian of that child should contact us and instruct us as to what to do with the Personal Data.
7. COOKIES
By visiting our Platforms, we and third party websites may place cookies and similar tracking tools on your browser to collect information that may be considered personal such as your device's internet protocol address, browser type or version, time of your visit and geographical locations. Such information is used to enhance our technical functions and improve a user- friendly experience while visiting our Platforms. Information is also used for targeted marketing on other sites based on browsing activities.

Eon is not responsible for information, privacy or other practices of any third parties operating any website with links to or on Eon Platforms. The inclusion of any link to or on Eon Platforms does not imply endorsement of the linked sites or their services by us. We are not responsible for data collection, use, retention or sharing or security policies or practices of such other third parties including app developers, app providers and social media platform providers. We have no control and assume no responsibility for any Personal Data you disclose to other third parties through or in connection with Eon Platforms. These other third parties may have their own privacy policies and we strongly suggest that you review them to understand how your Personal Data may be processed by them.
10.JURISDICTION AND CROSS BOARDER TRANSFER
We may store and process Personal Data in any country where we have facilities or in which we engage third party service providers which may be outside the European Economic Area. By using Eon Platforms you consent to the transfer of Personal Data to countries outside your country of residence, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Data.
We will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in a manner consistent with this Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place.

If we provide this service on the basis of an agreement with you, we consider the processing of your Personal Data to be necessary for the performance of the contract and lawful under (Article 6/1(b) GDPR).
